The proposed bill, known as the Kentucky Ratepayer Protection Act, aims to safeguard local residents from potentially soaring electricity costs associated with these data hubs.
Representative Adam Moore, who serves District 45, is the driving force behind this legislation. He emphasizes that the arrival of new data centers should not burden the everyday Kentuckian with increased utility bills. "If they are coming into Kentucky and they're bringing the things they are promising to do, they're not doing it on the backs of the average Kentuckian," Moore asserts confidently.
Many Kentuckians have expressed concerns about how the establishment of these energy-intensive data centers might lead to higher utility expenses. This concern is valid, considering that data centers have a voracious appetite for electricity, often necessitating additional power infrastructure to meet their demands. The legislation stipulates that any new electricity generation, transmission, or distribution infrastructure created solely for the benefit of data centers cannot be funded by other customer classes. Moore elaborates, "Anything new that is generation, transmission, distribution that solely serves data centers cannot be passed on to other customer classes. Now, anything that provides a dual benefit... they can pay on the existing cost of that and that can be shared proportionally. But, anything new that solely serves the data centers has to be paid by them and cannot go to other customer classes."
While the focus of the bill is primarily on electricity costs, Moore acknowledges that there are other pertinent issues related to data centers, such as their water consumption and noise pollution. Initially, he considered including these aspects in the legislation but ultimately decided to narrow the focus to enhance its chances of being approved by the General Assembly. He stated, "What can we get passed that really meets the main need? And the main need is to make sure that people's electricity is affordable and that they're not paying for these things that are coming in by these multi-billion dollar corporations."
Power company executives have previously urged Kentucky lawmakers to look favorably upon data centers, citing the millions of dollars in local tax revenue they could generate. While there is a consensus among lawmakers that Kentucky must remain competitive in attracting data centers, many emphasize that any legislation related to artificial intelligence should take local residents' concerns seriously.
